Yesterday at 7:30 AM, I was barreling along Route 88 on my way to a press conference in the State Capitol when The New York Times broke the story that Governor Cuomo reportedly wants to permit a shale gas fracking demonstration project in the Southern Tier.

Hallelujah: No Final Fracking Decision Yet/NYS Moratorium Holds/Urgent Help Needed

I trust that you have been well since we last communicated. I write to bring you up to date about my activities and to request your immediate assistance with a Legislator sign-on letter to Governor Cuomo.

Hallelujah: Final Fracking Decision Delayed Yet Again

You will recall that Governor Cuomo suddenly declared on 2/8/12 that a "final decision" would be made "in a couple of months" about permitting shale gas fracking in New York. His emphatic statement caused elation among pro-frackers and despair among environmentalists. It looked like the bitter end was near.

I am thrilled to report that the Governor's decision has reportedly been further delayed by the Revised Draft SGEIS proceeding. With your on-going assistance, NEW YORK'S SHALE GAS FRACKING MORATORIUM is still holding rock-steady against seemingly insurmountable odds

The bottom line is that until DEC fulfills the onerous requirements of the State Environmental Quality Review Act (SEQR) as well as Executive Order No. 41, Governor Cuomo will have an extremely hard time adopting a Final SGEIS that permits shale gas fracking in New York.

I am exceedingly pleased to let you know that there is a growing sense that New York's de facto moratorium on horizontal hydrofracturing in Marcellus Shale will likely continue throughout 2012. That is thrilling news, though I hesitate to mention it to avoid jinxing our shut-out. Keep pushing. No let-up.

I write to thank everyone who has worked so hard these last two and a half grueling years to maintain New York's de facto moratorium on Marcellus Shale horizontal hydrofracturing. Your diligence and sacrifice are greatly appreciated. What you have collectively achieved is almost beyond belief. I am sure the gas industry is chagrined to feels likewise.

Even against that background of impressive political achievement, the last ten days have been noteworthy in the annals of NYS grassroots action. Wow.

FYI, I updated Governor Cuomo yesterday regarding the more than 20,900 signatories to the Withdraw the Revised Draft SGEIS Coalition Letter. Please note the last paragraph of the letter below. If that proposal can be implemented, there would be no horizontal hydrofracturing in New York's tight shale for a very long time to come.
