Governor Cuomo is scheduled to visit Binghamton, NY tomorrow: Thursday 2/24/11.

We urgently need to request him to expand the scope of the Department of Environmental Conservation's (DEC) draft Supplemental Generic Environmental Impact Statement (SGEIS). This is a critical requirement for fulfilling Executive Order No. 41.

Many activists, officials and groups have recently contacted me with a multitude of questions about Executive Order No. 41. Suffice it to say that there is a great deal of misleading information and confusion surrounding this critically important matter.

I trust you had a very happy holidays. I am pleased to write you today about taking our Marcellus Shale gas campaign to the next level of success.

During the last 17 months, we collectively thwarted New York State's efforts to adopt a fatally flawed draft Supplemental Generic Environmental Impact Statement that would have allowed Marcellus Shale horizontal hydrofracking to proceed. That achievement is simply breathtaking. I still cannot believe we prevailed against some of the biggest corporations on the planet.

Stunning Developments/Cuomo is Our Next Target

I write to bring you up to date on the stunning developments regarding the veto of the mini-moratorium bill and Governor David A. Paterson's landmark Executive Order 41.

When the Governor vetoed the mini-moratorium bill late last Saturday, it was reported that he would issue an Executive Order requiring that "...if approved, high-volume, horizontal hydraulic fracturing would not be permitted until July 1, 2011, at the earliest."

As you probably know, the Marcellus Shale mini-moratorium bill was vetoed by Governor Paterson late Saturday.

More importantly, the Governor today issued "Executive Order No. 41: Requiring Further Environmental Review." His order bars Marcellus Shale horizontal hydrofracking permits until a second draft SGEIS is issued, public comment is accepted and a report is submitted to the Governor regarding "the regulatory conditions that are necessary to include in oil and gas well permits to protect public health and the environment."

I am very pleased to let you know that the coalition letter requesting Governor Paterson to withdraw the draft SGEIS before leaving office has garnered more than 2,400 signatories. It was sent to the Governor earlier this week. See cover letter below.

A total of 85 groups have endorsed the coalition letter. Signatories are involved with nearly 400 organizations and include elected officials, environmental organizations, civic and good government groups, farmers, business owners, religious leaders, wineries and all manner of concerned citizens.

I am writing to all signatories to my withdraw the draft SGEIS coalition letter. We are nearly 11,000 strong. Thank you so much for your help during the last year.

I implore you to sign a new letter to Governor Paterson. It requests him to withdraw the draft SGEIS before he leaves office. The governor is under brutal pressure on Marcellus Shale matters. One more big push might send him over the brink.

Thank you all so much for making Monday's Binghamton Rally and EPA hearing a tremendous success. We sent a critically important message to regulatory authorities, elected officials, candidates for higher office, the gas industry and the nation as a whole.

I believe we also achieved our goal of continuing to build momentum to withdraw the draft SGEIS. We are bigger, stronger and more focused due to our strong showing.

This demonstration of grassroots activism and citizen democracy will take place prior to the Environmental Protection Agency's national hydrofracturing hearing. EPA's event will be held next door. See below.

There was a trifecta of articles in the Ithaca Journal, including a front-page piece with a big photo of Mr. Cuomo speaking to activists.

A version of that article also ran on the front-page of the Binghamton Press and Sun Bulletin.
