The last few weeks have been a blur because a lot of us have been busy preparing our big sprint to the shale gas fracking finish line. That is why I write today.

Each and every day between now and February 13 - 27th could decide the fate of shale gas fracking in New York. I write to implore you to implement a precise plan of action that should allow us to survive the coming weeks. Pull out all the stops. This is definitely the moment of truth.

DEC's shale gas Revised Rulemaking proceeding has to be completed by 2/27/13. Otherwise, it must be restarted by law. In order to beat that looming deadline, both the infamous DOH "health impact analysis" Review and a Final SGEIS would have to be completed beforehand. FYI, February 13th is a regulatory notice deadline that could apply to the SGEIS.

Our Plan of Action

We Must Make Sure That The DOH Review Is Not Completed by 2/27/13. That goal is critical because the Cuomo administration has pledged that neither a Final SGEIS nor a Revised Rulemaking proposal will be adopted until the DOH Review is done. It is essentially all or nothing.

I want to thank everyone who heeded the call yesterday and showed up at an unprecedented State-of-the-State Rally. There were probably 1,500 to 2,000 of us. We totally dwarfed the pro-frackers.

Governor Cuomo refuses to require public participation for the DOH Review of the "health impact analysis" conducted by DEC. As a result, DEC remains on-track to make a final decision whether to permit Marcellus Shale gas fracking in New York by 2/27/13.

It is imperative that a DOH Review conducted completely in secret without any public input must not be used to support adoption of a Final SGEIS or DEC's shale gas Revised Rulemaking proposal. The DOH Review must be put on-hold until all its shortcomings have been resolved.

A truly impressive coalition of New York government officials is fighting tooth and nail to require public participation for the State Health Department's secret Review of DEC's Marcellus Shale "health impact analysis."

The future of Marcellus Shale gas extraction in New York could depend on the outcome of this battle.

First, a total of 118 government officials sent a coalition letter to Governor Cuomo which states:

"Until you have fulfilled our public participation requests, we ask that you:

a) Put on hold DOH’s “health impact analysis” Review/Assessment and

b) Make sure that DEC adopts neither a Final SGEIS nor a shale gas Revised Rulemaking proposal.

Second, the Chairs of the Assembly Environmental Conservation (R. Sweeney) and Health (R. Gottfried) Committees as well as the Administrative Regulation Review Commission (C. Lavine) just sent an extremely important letter to Commissioners Martens and Shah about the DOH Review. The letter states:

I am thrilled to let you know that a total of 104 New York State government officials, including 22 Mayors and Town Supervisors, are now signatories to the coalition letter which requests that Governor Cuomo immediately require public notice, public comment and a public hearing for his Department of Health's Review of DEC's "health impact analysis" of shale gas extraction.

Many of those signatories represent communities throughout New York's Marcellus Shale formation.  This respectfully submitted request will be extremely difficult to ignore.

It has been a truly tumultuous ten days. Thanks for all your help. I write today because the chips are down. We are all in. It is do or die.

The Cuomo administration announced that it hopes to decide whether to permit shale gas fracking in New York by 2/27/13. That is only 79 days away.

In order to meet that deadline, the Cuomo Administration faces an extraordinarily tough PROCEDURAL challenge. It would likely have to:

a) complete its DOH Review of the "health impact analysis" in DEC’s Revised Draft SGEIS;
b) adopt a Final SGEIS; and
c) finish DEC's Revised Rulemaking proceeding.

The weakest link in this plan is the completion of the DOH Review. That Review is being undertaken in total secrecy with no public participation. It is imperative that it be delayed, scrapped or sent back to the drawing board for extended comment.
