Dear Mr. Martens:

The eyes of New York State are upon you and Governor as you take, or don't take, action regarding hydrofracking and its impact on our natural resources, most notablly our water. The utter lack of regulation and oversight in both Pa. and NYS was highlighted in this past Sunday's New York Times, and I am fully confident you have read that article. I also feel confident that you have already availed yourself to the 30,000 or more pages of documentation that the newspaper staff combed through to reach the conclusions it put forth. With all this documented evidence of our incapacity to handle even the waste produced by high volume hydraulic fracturing (forget about all the damage done at the front end for one nanno second), how on earth could you let the state proceed with out taking much more time to review the SGEIS than is currently proposed -- or without waiting until the EPA study is completed as well. It is time for you in your capacity as DEC Commissioner to cease the "burning of NYS's furniture to heat its house." Champion rather conservation and alternative energies, but most urgently, implement the suggestions made by Walter Hang of Toxics Targeting, which are:

Expand the scope of the draft SGEIS to include additional concerns, notably how to manage gas drilling wastewater;

2. Establish a Citizens and Technical Advisory Committees to help DEC revise the draft SGEIS;

3. Provide at least 30 days public comment to identify additional issues to be included in the draft SGEIS scope;

4. Require individual EIS reviews for horizontal hydrofracturing permits, "GA effluent limitations" for hydrofracturing, deep well injection and wastewater treatment as well as updating DEC's 1992 GEIS
