We, the undersigned, write to request that you take immediate action to fully review and resolve six critical issues before permitting horizontal hydraulic fracturing to extract natural gas from New York's Marcellus Shale formation. As you know, many of us have additional objections, but we wanted to formally express our consensus on these six critical issues.

Thank you and Eric for taking the time to call me last Monday. I know that you are both very busy and appreciate your willingness to discuss the Hydraulic Fracturing Advisory Panel Pledge and the Withdraw the Revised Draft Supplemental Generic Environmental Impact Statement (RD SGEIS) coalition letter with more than 22,000 signatories that I provided for your consideration.

USDA Categorical Exclusion (CE) Memo

I wanted to touch base with you before heading out tonight. I’ve listed some bullets below on the natural gas issue we had discussed. Take a look at what I’ve put together and let me know if you have any questions moving forward. I’d be happy to put you in contact with our author of the AN, Frank Mancino, working on detail in our Rural Housing Service.

Administrative Notices (AN) provide clarification and guidance on the application of existing regulations and policies. RD is not proposing any new policy in terms of NEPA reviews.

I write to request that you immediately require an environmental impact statement pursuant to the New York State Environmental Quality Review Act (SEQR) regarding the proposed use of Liquid Petroleum Gas (LPG) to hydraulically fracture Marcellus Shale in New York.

I write to request that you take immediate action to assess, avoid or mitigate any adverse environmental impacts associated with mortgage loans involving properties with gas leases in New York State. I believe that this action is required pursuant to the New York Environmental Quality Review Act (SEQRA): 6 NYCRR Part 617 State Environmental Quality Review (SEQR) [Statutory authority: Environmental Conservation Law Sections 3-0301(1)(b), 3-0301(2)(m) and 8-0113].

Dear Mr. President:

I respectfully write regarding the National Environmental Policy Act (NEPA) implications of utilizing horizontal hydrofracturing to extract natural gas from America's vast shale formations.

In your 2012 State of the Union Address, you declared:

"We have a supply of natural gas that can last America nearly one hundred years, and my Administration will take every possible action to safely develop this energy (emphasis added). Experts believe this will support more than 600,000 jobs by the end of the decade. And I’m requiring all companies that drill for gas on public lands to disclose the chemicals they use. America will develop this resource without putting the health and safety of our citizens at risk (emphasis added).

I have the honor of presenting for your review a coalition letter which requests that you immediately withdraw your Department of Environmental Conservation's (DEC) Marcellus Shale Revised Draft Supplemental Generic Environmental Impact Statement (RD SGEIS) because it fails to fulfill the requirements of Executive Order No. 41 and cannot assure that horizontal hydrofracturing will be done "safely" in New York's tight shale formations.

I write to bring to your attention the Ferrugia family near Jamestown, NY that has not been able to drink their well water since 2007 after a gas extraction well was drilled approximately 300 feet from their home. According to Chautauqua County Health authorities, “This is a well documented case showing drinking water impacts that are seemingly related to gas well development.”
