We must not allow tree felling to occur, as it is in Pennsylvania right now, so that the Constitution (what a name!) Pipeline will move ahead. We simply cannot allow the transport of fossil fuels through our state. It's too dangerous, and we are leading the way with renewable fuel technologies, so why would we allow this?

I write today because I've been notified that the Constitution Pipeline Company had requested the Federal Energy Regulatory Commission yesterday to begin partial tree cutting in New York State for their proposed natural gas pipeline even though our State Department of Environmental Conservation has NOT granted a Section 401 Water Quality Certification required for the proposed pipeline to be built. The firm is clearly trying to "jump the gun" before any Section 401 Water Quality Certification decision in order to make the proposed 124-mile Constitution Pipeline a fait accompli.
I telephoned your Executive Office this morning and spoke with a kind assistant who registered my concerns, but indicated that I would be reported anonymously as a resident of ZIP 13210. She indicated that I was not alone and MANY (her emphasis) calls on this environmental issue were being received.
With those concerns in mind, I respectfully request that you require your Department of Environmental Conservation to issue a Supplemental Findings Statement to revise its definition of high-volume hydraulic fracturing (HVHF) to prohibit all forms of shale fracking in New York, not just HVHF based on "300,000 or more gallons of water."

Constitution Pipeline - Water Quality Permit

I write today because in twelve short years, we are on target to reach the 1.5 degree Celsius average global temperature beyond which COP21 nations agree we must avoid exceeding in order to avoid serious harm to the planet and society. The climate will continue to warm for the next 30 to 40 years at its current rate no matter what we do for carbon dioxide because of inherent lags and interaction with the oceans with carbon dioxide. That is not true for methane. If we stop methane emissions now, we’ll slow global warming now. We can keep the planet below 1.5 degrees Celsius for several decades into the future. We’ve got to get rid of natural gas to do that.
The idea of building any infrastructure to promote further use of natural gas now is crazy. We should not be building pipelines. We should not be repowering power plants. We should be putting our resources into the infrastructure we need for the renewable future that has got to start now.
Our sole avenue for rejecting the Constitution Pipeline at this juncture is the Water Quality Certification for New York.
I request that you deny all pending applications for Water Quality Certification for the proposed Constitution Pipeline and all other natural gas, crude oil and petroleum product infrastructure projects in New York due to the state's well-documented inability to fulfill the requirements of Section 401 of the U. S. Clean Water Act. It is our only avenue to rejecting the pipeline at this point, which we must do.

I am painfully aware that when they reach our age (about mid-century) they will be dealing with the very real consequences of your choices and actions regarding expanding carbon-based energy systems here in NY. The long-term continuation of our current way of life over the next few generations is much more important than any short-term economic wants or the continued profits of our existing carbon-based energy sytems. I know that there are many "voices" encouraging you to support futther carbon-based projects here in NY, and that they are telling you it will bring jobs or money into the State. Let's be honest, those voices are telling you whatever they have to tell you to protect their own interests - which are only short-term, only about their profit and only about them - not New York, it's people or the state itself.
Stand with the people of New York, not the corporations that want to extract wealth from New York. As a father and homeowner I have invested in installing enough solar generation on our home to fully meet our family's electrical needs for the next quarter century. I invite you to join me as the leader of our state in strongly supporting similar investments, and equally in stopping and preventing further carbon-based energy damages.
I strongly request that you deny authorization for all proposed natural gas and oil pipelines, power plant conversions, new generating facilities and other infrastructure projects that would perpetuate New York's addiction to highly polluting fossil fuels for many decades to come.
I also request that you take urgent action to maximize energy efficiency across New York in order to minimize energy demand and strengthen our economy.
Your proposed 2016 agenda, Built to Lead, states, "Since taking office, the Governor has created and pursued the most aggressive environmental and sustainability agenda of any state in the country to mitigate climate change."
With all respect, wind, solar and geothermal renewable sources met 1.1% of New York's total primary energy requirement in 2013 according to a New York State Energy Research and Development Authority (NYSERDA) report, entitled: Power Trends, New York State Energy Profiles, 1999-2013.
Including hydropower generated by plants that average 50 years old, New York's total primary consumption of energy from renewable resources is less than 10% according to NYSERDA.
Given the urgent need to reduce reliance on polluting fossil fuels, I believe New York must cut coal, oil and natural gas burning without further delay.
I am one of more than 750 signatories to a detailed coalition letter which requests that you take action to address these concerns in order to end New York's addiction to fossil fuels.

Prohibiting all types of Fracking

I write today because I have two issues to address.
One is to reject the Constitution Pipeline Company, LLC request to seek authorization from FERC to begin tree felling in New York even Department of Environmental Conservation has not granted a Section 401 certification for the proposed pipeline. This would be a terrible unnecessary destruction of woodland areas if the pipeline is not approved.
The other is to respectfully request that you require your Department of Environmental Conservation to issue a Supplemental Findings Statement to revise its definition of high-volume hydraulic fracturing (HVHF) to prohibit all forms of shale fracking in New York, not just HVHF based on "300,000 or more gallons of water."
This is critically important because DEC received a gas well permit application on April 24, 2015 to frack Marcellus shale using "gelled" propane instead of water in Tioga County.
Your administration clearly knew that its HVHF definition was inadequate to implement the No-Action decision in the Findings Statement issued on June 29, 2015.
Given that shortcoming, I request that you take immediate action to fulfill the shale fracking prohibition specified in the Findings Statement:
"Based on unavoidable adverse environmental impacts and uncertainty regarding the science surrounding high-volume hydraulic fracturing and its potential impacts to public health and the environment, the Department finds that the best course of action is to select the No Action alternative. Selection of the No Action alternative means that the Department will not establish a high-volume hydraulic fracturing permitting program; that no individual or site-specific permit applications for wells using high-volume hydraulic fracturing will be processed; and that high-volume hydraulic fracturing will be prohibited in New York State (emphasis added)."
