Greetings,

Get fired up for a possible "do or die" month regarding the proposed Constitution Pipeline. Each and every one of the next 30 days could be critically important in deciding the fate of that 124-mile fossil fuel monstrosity because no tree felling can be conducted between April 1st and October 31st.

Despite an intensifying barrage of informed citizen input and extensive press coverage, Governor Cuomo has so far failed to fulfill our request that he DENY the Section 401 Water Quality Certification required for the proposed Constitution Pipeline to be built.

The Governor's inaction speaks volumes. As a result, we can have no illusions about where things stand. Our efforts simply must make a significant quantum jump in the days ahead.

On the bright side, if our request receives a favorable reply, the project would be killed dead and a shockingly great precedent would be set. Wouldn't that be nice?

If we prevent DEC from granting a Section 401 WQC for the next month and prevent FERC (Federal Energy Regulatory Commission) from overturning its earlier decision to withhold tree felling approval in New York, no trees could be cut for the proposed Constitution Pipeline for at least the next seven months.

The Office of New York State Attorney General Eric Schneiderman wrote FERC yesterday to reiterate concerns about tree-felling. Thank you, Mr. Attorney General. Interestingly, the Cuomo administration wrote FERC about conducting an "independent safety risk analysis" of the AIM (Algonquin Incremental Market) pipeline, notably its risk to the Indian Point nuclear generating facility.

As you can read here four state agencies requested that "Until this independent safety risk analysis is completed, we ask the [sic?] FERC stay and reconsider its prior determination to grant a certificate of public convenience and necessity to ensure that the health and safety of all New Yorkers is adequately protected."

That begs the stunning question why DEC earlier granted the Section 401 Water Quality Certification required for the giant AIM pipeline project to begin construction. Note that the letter does not oppose the AIM pipeline.

WE MUST CRANK UP THE HEAT TO THE MAX

For all these important reasons, I implore you to write and call Governor Cuomo at 518 474 8390 to request that he: a) TAKE IMMEDIATE ACTION TO PREVENT ANY TREE FELLING in New York for the proposed Constitution Pipeline and b) DENY the Section 401 Water Quality Certification required for its construction.

Hammer home DEC's documented inability to prevent at least 114 major fossil fuel pipeline explosions, fires, ruptures and toxic discharges, including many water quality violations that were never cleaned up to state environmental protection standards.
