Greetings,
I write to request that you take immediate, urgent action to kill the proposed Constitution Pipeline. This crucial matter could be decided any moment.
I want to thank all the Fractivists who traveled from near and far yesterday for yet another stupendous State of the State Rally on the Empire State Plaza Concourse immediately before Governor Cuomo's address. Wow, did we rock the house.
We sent the Governor a loud, clear and unmistakable message that he must DENY all pending Section 401 Water Quality Certification applications for fossil fuel pipelines and infrastructure projects because his Department of Environmental Conservation (DEC) clearly cannot fulfill the applicable requirements of the U. S. Clean Water Act.
This is beyond dispute because we documented a total of 114 major pipeline explosions, fires, ruptures and toxic discharges using DEC's own data, including many massive releases that were never cleaned up to meet state environmental protection standards.
This analysis proves DEC cannot meet its obligation that: "All necessary precautions shall be taken to preclude contamination of any wetland or waterway..."
If our respectful request receives a favorable reply, Governor Cuomo would kill the proposed Constitution Pipeline and other proposed fossil fuel pipelines and infrastructure project with pending Section 401 Water Quality Certification applications in New York. That is what we are working to achieve.

What is Next?
Last Friday, the Constitution Pipeline Company, LLC submitted a request to FERC (Federal Energy Regulatory Commission) for authorization to begin "tree-felling activities" by tomorrow: 1/15/16.
This is clearly an attempt by the applicant to "jump the gun" and conduct an "end run" on Governor Cuomo's authority to decide the Section 401 Water Quality Certification application matter.
Our strategy is to deluge Governor Cuomo with requests that DEC DENY the Section 401 Water Quality Certification application for the Constitution Pipeline.

All hands on deck!!! Every moment, every hour, every day is now immensely important in the epic battle to break New York's addiction to fossil fuel consumption by killing all proposed pipelines, storage infrastructure and power plant conversions.
PERSUADE ALL GROUPS, ELECTED OFFICIALS AND FRACTIVISTS TO FOCUS ON GOVERNOR CUOMO. RESPECTFULLY DEMAND THAT HE IMMEDIATELY DENY THE SECTION 401 WATER QUALITY CERTIFICATION REQUIRED FOR CONSTRUCTION OF THE PROPOSED CONSTITUTION PIPELINE.
THIS FIGHT WILL SET A HUGE PRECEDENT, FOR GOOD OR FOR ILL, ON THE FUTURE OF FOSSIL FUEL CONSUMPTION IN NEW YORK. NO EXCUSES. MAKE IT HAPPEN.
