Greetings,

It has been eight days since the review and comment period ended for the Final Supplemental Generic Environmental Impact Statement (SGEIS). No legally-binding Findings Statement has been issued by the Department of Environmental Conservation (DEC) and no final decision has been rendered to conclude the SGEIS proceeding.

So much for the belief voiced by various organizations that a shale fracking prohibition is a done-deal. Some groups already thanked Governor Cuomo without actually knowing the contents of the Findings Statement. That is like supporting legislation you have not read. The devil is in the details.

The gas and oil industry will surely lobby until the bitter end. As a result, the Findings Statement could be revised all the way down to the wire.

As Yogi Berra famously said, "It ain't over till it's over." That is why we must take nothing for granted.

Please Keep Calling Governor Cuomo at 518 474 8390 until the Final SGEIS Findings Statement is issued.

You will hear a recording. Press 2 to leave a message or press 3 to speak with a live person. Either option is fine.

State very respectfully that you request DEC's Findings Statement to implement:

A. the No - Action alternative in the Final SGEIS.

B. the Department of Health's (DOH) key policy recommendation:

"Until the science provides sufficient information to determine the level of risk to public health from HVHF [high-volume hydraulic fracturing] to all New Yorkers and whether the risks can be adequately managed, DOH recommends that HVHF should not proceed in NYS."

C. a requirement that the DEC's final decision in this matter cannot be revisited without conducting a new Environmental Impact Assessment pursuant to the State Environmental Quality Review Act.

Please thank the Governor for his public service under trying circumstances.

Conclusion

For nearly six years, our campaign has systematically subjected Governor Cuomo to relentless, focused, highly informed advocacy efforts involving thousands of grassroots activists. That 24/7 effort has played a crucial role in keeping shale fracking out of New York since 2008.

Our work was instrumental in killing multiple inadequate Draft SGEIS proposals as well as the original 2012 Department of Health "review." That is why Governor Cuomo was ultimately forced to fulfill our request that DOH conduct a comprehensive shale fracking Public Health Impact Study.

When that Public Health Review was released on December 17, 204, New York's shale fracking prohibition resulted. I know of no other environmental campaign that has achieved this level of sophisticated technical know-how combined with dogged grassroots activism. I commend you for carrying us all this far.

Nevertheless, anything can happen until the Findings Statement is issued. No resting on laurels. We need a super big finish to win this epic contest.

Keep battling until the final horn sounds.

Very best regards,

Walter
