Unbelievably Great Day/DOH Review Strategy Works Like a Charm/Thank You All/Not Over Yet

Greetings,

Guess who blinked?

I am thrilled to let you know that the State Department of Health's Review of the "health impact analysis" conducted by DEC will not be completed by a key 2/13/13 deadline.

As a result, no Final SGEIS has been adopted.

As a result, DEC's shale gas Revised Rulemaking proceeding is extremely unlikely to meet its 2/27/13 deadline. In that event, the proceeding would expire.

In short, New York's shale gas extraction moratorium is still holding solid as a rock, as least for now. We continue to succeed against seemingly insurmountable odds. It is hard to believe.

The campaign we launched the evening of November 28th to make sure that the DOH Review is not completed due to a total lack of public participation is working like a charm.

As I told you then, NO DOH REVIEW, NO FINAL SGEIS, NO REVISED RULEMAKING.

Thank you all so much for your hard work. We have much to do in the coming weeks, but this is an unbelievably great moment.

I salute the 2,963 signatories of the 11/28/12 coalition letter calling for DOH Review public participation: http://www.toxicstargeting.com/MarcellusShale/letters/2012/11/28/cuomo

Special thanks to the 136 government officials who took a strong stand against a DOH Review conducted totally in secret without any public input. I pay homage to Binghamton Mayor Matt Ryan for his amazing efforts. See: http://www.toxicstargeting.com/MarcellusShale/cuomo/gov-coalition-letter...

Thanks to each and every one of the 65 legislators who signed Assemblywoman Barbara Lifton's bipartisan letter calling for the DOH Review to be put on-hold pending fulfillment of requested public participation requirements. I appreciate all the efforts so many activists made during these long months. The press coverage of that work is impressive: http://www.toxicstargeting.com/MarcellusShale

More shortly.

Cheers,
