New Coalition Letter to Governor Cuomo: Oppose a Possible Southern Tier Fracking Demonstration Project and Require Full Enforcement of Executive Order No. 41

Dear Governor Cuomo:

We, the undersigned, write to request that you take immediate action to fulfill the mandates specified by Executive Order No. 41. We ask you to:

1) Withhold issuance of shale gas drilling permits for any demonstration project in Broome, Tioga and Chemung counties, or any other areas of New York. The Executive Order requires that "pursuant to SEQRA, no permits may be issued prior to the completion of a Final SGEIS [Supplemental Generic Environmental Impact Statement, not in the original]..."

2) Withdraw the Revised Draft SGEIS in order to expand its scope to address a) Liquid Petroleum Gas (LPG) hydraulic fracturing recently proposed for 135,000 acres in Tioga County and b) New York State mortgage lending programs involving properties with gas and oil leases. These two issues are not analyzed "comprehensively" by the Revised Draft SGEIS. As a result, your Department of Environmental Conservation (DEC) cannot "ensure that such impacts are appropriately avoided or mitigated consistent with the State Environmental Quality Review Act..."

3) Require DEC to provide a report on "the status of the Final SGEIS and the regulatory conditions that are necessary to include in oil and gas well permits to protect public health and the environment." That report is mandated "subsequent to the conclusion of the public comment period..."

I trust that you have been well since we last communicated. I write to bring you up to date about my activities and to request your immediate assistance with a Legislator sign-on letter to Governor Cuomo.

Hallelujah: Final Fracking Decision Delayed Yet Again

You will recall that Governor Cuomo suddenly declared on 2/8/12 that a "final decision" would be made "in a couple of months" about permitting shale gas fracking in New York. His emphatic statement caused elation among pro-frackers and despair among environmentalists. It looked like the bitter end was near.

I am thrilled to report that the Governor's decision has reportedly been further delayed by the Revised Draft SGEIS proceeding. With your on-going assistance, NEW YORK'S SHALE GAS FRACKING MORATORIUM is still holding rock-steady against seemingly insurmountable odds

The bottom line is that until DEC fulfills the onerous requirements of the State Environmental Quality Review Act (SEQR) as well as Executive Order No. 41, Governor Cuomo will have an extremely hard time adopting a Final SGEIS that permits shale gas fracking in New York.

Landowners in Tioga County say they will start applying to the DEC for permits to start fracking for natural gas, but the process is called propane fracking.

This uses liquefied petroleum gas, not a water and chemical solution, to break up rock and release gas underneath.

It's not hydrofracking which is currently banned but under review in New York State.

Tioga County (WENY) - Deep shale hydrofracking could be coming to the Southern tier a lot sooner than a lot of people think. A company has come up with a way to do it without using millions of gallons of water.

The leadership of a group of landowners in Tioga County, New York has reached an agreement with gas drillers to begin developing the Marcellus Shale using liquid propane as a fracking agent.

Brokers of the deal, between eCorp, GasFrac Energy Services, and the Tioga County Landowners Association, believe that fracking with natural gas is not included under a New York state moratorium that prevents drillers from using high volume hydraulic fracturing. The moratorium was put in place in 2008 due to environmental concerns, pending the completion of a review by the state DEC.

I write to request that you take immediate action to assess, avoid or mitigate any adverse environmental impacts associated with mortgage loans involving properties with gas leases in New York State. I believe that this action is required pursuant to the New York Environmental Quality Review Act (SEQRA): 6 NYCRR Part 617 State Environmental Quality Review (SEQR) [Statutory authority: Environmental Conservation Law Sections 3-0301(1)(b), 3-0301(2)(m) and 8-0113].

President Obama Letter regarding NEPA implications of horizontal hydrofracturing of shale to extract natural gas

Dear Mr. President:

I respectfully write regarding the National Environmental Policy Act (NEPA) implications of utilizing horizontal hydrofracturing to extract natural gas from America's vast shale formations.

In your 2012 State of the Union Address, you declared:

"We have a supply of natural gas that can last America nearly one hundred years, and my Administration will take every possible action to safely develop this energy (emphasis added). Experts believe this will support more than 600,000 jobs by the end of the decade. And I’m requiring all companies that drill for gas on public lands to disclose the chemicals they use. America will develop this resource without putting the health and safety of our citizens at risk (emphasis added).
